By attending this session or viewing this content, YOU (participant) acknowledge and agree that the host, speaker, or presenter (The Phantom Hour, LLC) is not liable for any loss, damages, or consequences—direct or indirect—arising from your use of or reliance on the information provided.

 

By participating in this group, YOU acknowledge that no one can predict the market with certainty, and no indicator is 100% accurate. Market movements can be influenced by news, tweets, and political events, which can shift prices instantly. YOU understand that unfavorable outcomes may occur and that YOU are fully responsible for your own entry and exit strategies.

 

YOU assume full responsibility for your own investment decisions.

 

YOU agree to fully indemnify, defend, and hold harmless The Phantom Hour, LLC, including its officers, directors, employees, agents, affiliates, and representatives, from and against any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or related to:

• Misuse or misrepresentation of The Phantom Hour, LLC’s content

• Unauthorized application of strategies in any public or private setting

• Attempts to sell, license, or commercially exploit group information

 

This indemnification applies to the fullest extent permitted by U.S. law.

 

All content presented during Zoom meetings—including discussions, strategies, charts, opinions, and analyses—is strictly for educational and informational purposes. Nothing is financial, investment, legal, or tax advice. YOU should consult a licensed professional before making any decisions.

 

Trading involves significant risk. YOU are encouraged to consider your financial situation and consult with licensed advisors.

 

No selling occurs during sessions. Participation is free. This group is independent and not affiliated with any other trading group or organization.

2. International Use & Non-U.S. Jurisdiction Notice

By accessing the Site or Membership from outside the United States (including Canada, the U.S. Virgin Islands, Puerto Rico, Guam, or any foreign jurisdiction), YOU agree:

  • This Agreement is governed exclusively by Nevada law

  • YOU consent to Nevada-based arbitration

  • YOU are responsible for complying with your local laws

  • Foreign consumer protections do not apply

  • Participation is prohibited where restricted by local regulation

 

3. Membership Access & Eligibility

By registering or accessing member content, YOU agree to:

  • Be at least 18 years old

  • Provide accurate information

  • Not share login credentials

  • Not grant access to non-members

Violations result in immediate removal without refund.

To the fullest extent permitted by law, YOU release and discharge The Phantom Hour, LLC, including its owners, officers, directors, hosts, moderators, employees, contractors, and volunteers, from any claims arising out of:

  • Participation in classes or sessions

  • Use of educational material

  • Trading decisions

  • Indicator or tool usage

  • Technical issues or interruptions

  • Losses or damages of any kind

This includes claims based on negligence.

 

7. Limitation of Liability

To the fullest extent permitted by law, The Phantom Hour, LLC shall not be liable for:

  • Indirect, incidental, punitive, special, or consequential damages

  • Lost profits, revenue, assets, or opportunities

  • Any trading losses

In no event will total liability exceed:

three times the most recent fee paid… or $250, whichever is greater.

This limitation applies regardless of:

  • User location

  • Legal theory

  • Whether damages were foreseeable

 

8. Indemnification

YOU agree to indemnify and hold harmless The Phantom Hour, LLC from any losses, claims, or expenses (including attorneys’ fees) arising from:

  • Your trading decisions

  • Your reliance on educational material

  • Your misuse of content

  • Your violation of this Agreement

  • Your violation of any applicable law

This obligation survives termination.

 

9. Use of TradingView Indicators — Disclaimer

TradingView indicators provided by The Phantom Hour, LLC are:

  • Impersonal

  • Not individualized

  • For educational use only

YOU control inputs, criteria, and outputs.

The Phantom Hour, LLC does not guarantee results or accuracy.

YOU accept full responsibility for reliance on any such tools.

 

10. Instructional Trade Callouts

Trades discussed are educational examples only.

They are not:

  • Recommendations

  • Signals

  • Advice

  • Trade directives

YOU alone are responsible for execution decisions.

 

11. Member Conduct Rules

YOU agree not to:

  • Share membership access

  • Distribute private content

  • Record or repost sessions

  • Harass others

  • Sell or exploit materials

  • Engage in disruptive or defamatory conduct

Violations result in removal without refund.

 

12. Payment Terms

All payments are:

  • Final

  • Non-refundable unless otherwise specified

  • Subject to Wix payment policies

Chargebacks constitute breach of this Agreement.

 

13. Intellectual Property Rights

All content belongs exclusively to:

The Phantom Hour, LLC

This includes:

  • Videos

  • Indicators

  • Scripts

  • Zoom recordings

  • Text

  • Graphics

  • PDFs

  • Website materials

YOU may not reproduce, sell, or distribute any of it.

 

14. Limited Revocable License

YOU receive a personal, non-transferable, revocable license to access material for educational use only.

License terminates immediately upon violation.

 

15. Disclaimer of Warranties

Everything is provided:

“AS IS” and “AS AVAILABLE.”

The Phantom Hour, LLC makes no warranties regarding:

  • Accuracy

  • Profitability

  • Completeness

  • Performance

YOU assume full responsibility for use of content.

 

16. Privacy Policy

Data is handled per:

  • Wix privacy standards

  • Internal policies of The Phantom Hour, LLC

 

17. Termination of Membership

Membership may be terminated without refund for:

  • Misconduct

  • Harassment

  • Sharing content

  • Chargebacks

  • Fraud

  • Violations of this Agreement

 

18. Binding Arbitration (Nevada)

All disputes must be resolved via binding arbitration in Nevada under AAA rules.

YOU waive:

  • Court trials

  • Jury trials

  • Class actions

 

19. Class Action Waiver

Claims must be brought individually.

No collective or representative actions permitted.

 

20. Governing Law

This Agreement is governed exclusively by:

 

Nevada law and U.S. federal law regardless of your location.

 

21. Updates to Terms

The Phantom Hour, LLC may revise this Agreement at any time.

Continued use signifies acceptance.

 

22. Acknowledgment

By accessing content or membership, YOU acknowledge that you:

1. I have read and fully agree to the Membership Agreement, Terms & Conditions, and U.S. Legal Disclaimer of The Phantom Hour, LLC.

2. I understand all content is for educational and informational purposes only, and not financial, investment, legal, or tax advice.

3. I confirm that I am solely responsible for all trading and financial decisions I make.

4. I acknowledge that trading involves significant risk, and no strategy, tool, or indicator guarantees results.

5. I understand The Phantom Hour, LLC provides no personalized advice, and any indicators or tools are impersonal and educational only.

6. I agree to release, indemnify, and hold harmless The Phantom Hour, LLC from any losses, damages, or claims related to my participation, actions, or decisions.

7. I agree to the Nevada governing law, Nevada-based binding arbitration, and class action waiver.

8. I understand my membership may be revoked without refund if I violate any Terms.

9. I certify that I am 18 years old or older.

10. I agree that accessing, registering, or continuing to use the site constitutes my legally binding electronic signature.
